A unique model of management of the administration of justice through arbitration has been ESTABLISHED for the Basque cooperative movement as a complementary instrument of conflict resolution. This arbitration is carried out on the basis of the rules of private law contained in Law 60/2003, of December 23, 2003, on Arbitration, as amended by Law 11/2011, of May 20, 2011, and in the Regulations on Cooperative Arbitration approved by the Plenary of the Higher Council of Cooperatives of the Basque Country on July 20, 2023. In arbitration, the parties submit to a regulated procedure and leave the resolution of the debate in the hands of BITARTU. Bitartu will adopt a binding decision for both parties, applying the law or equity, which puts a definitive end to the debate.
Bitartu is configured as a collegiate body, made up of persons of recognized prestige, independent persons with sufficient authority in Basque cooperative law, which contributes to creating a single interpretative doctrine, providing legal certainty to the agents and acting independently in its functions.
